ACCEPTANCE OF TERMS

Infoblast is provided to you subject to the following Terms and Condition ("T&C"), which may be updated from time to time without notice to you. In addition, when using particular Infoblast, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the T&C.

DESCRIPTION OF SERVICE

Infoblast benefits both the sender and the recipient. If you're sending a message, you can spend less time tracking people down for answers. If you're a recipient, it's easy for you to respond quickly and discretely to messages without having to make a phone call through various medium now known or hereafter developed (the "Service").

You also understand and agree that the Service may include advertisements and that these advertisements are necessary for the Service. You also understand and agree that the Service may include certain communications, such as service announcements and administrative, and that these communications are considered part of Infoblast and you will not be able to opt out of receiving them.

Unless explicitly stated otherwise, any new features that augments or enhances the current Service, including the release of new Infoblast properties, shall be subject to the T&C. You understand and agree that the Service is provided “as-it-is" and that Infoblast provider assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all medium necessary to access the Service.

USE OF SERVICES

You acknowledge that Infoblast provider makes no representations or warranties of any kind whatsoever in respect of the provision of the Services or its use. Infoblast shall use its best endeavours to ensure the continuity and efficiency of the provision of the Services at all times and shall not be held liable for any loss or damage whatsoever and howsoever arising.

You will be solely responsible for all information retrieved, stored and transmitted through the use of the Service. You agree to comply with all and not to contravene any applicable laws of Malaysia relating to the Service, including but not limited to the Communication and Multimedia Act 1998, and any amending acts thereto revising. You will not use the Service for any unlawful purpose including and without limitation, for criminal purposes. You will not use the Service to send or receive any unsolicited messages and/or messages, which are is offensive on moral, religious, racial or political grounds or which may cause any anxiety to any person including a company or corporation. You will not resell or sublet the Service to any third parties without prior written consent from Infoblast provider.

You hereby agree to indemnify and keep indemnified Infoblast provider from any loss, damage, liability, claims, proceedings, costs, expense, penalties or others of a similar nature, whether arising from, in connection with or attributable to any invasion of privacy, breach of confidence or privilege, breach of any applicable laws, whatsoever and howsoever arising, from the message or material transmitted or received via the Services including, but not limited to all acts or omission of you or any unauthorized use, operation, abuse or exploitation of the Services.

GENERAL PROVISIONS

Entire Agreement. The T&C constitutes the entire agreement between you and Infoblast provider and governs your use of the Service, superseding any prior agreements between you and Infoblast Provider with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Infoblast services, affiliate services, third-party content or third-party software.

Choice of Law and Forum. The T&C and the relationship between you and Infoblast provider shall be governed by the laws of Malaysia without regard to its conflict of law provisions.

Waiver and Severability of Terms. The failure of Infoblast provider to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision. If any provision of the T&C is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the T&C remain in full force and effect.

Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the T&C must be filed within one (1) year after such claim or cause of action arose or be forever barred.
